He injured his lower back when he was attempting to lift a tire rim off of a wheel balancer machine. The Employer dispute the extent of his injuries and the case was tried before an Admistrative Law Judge at the Division of Workers Compensation. The Judge rule in our favor and granted him a Permanent Total Award that included payment of all past medical treatment, all future medical treatment as well as lifetime payments in the amount of $525.00 per week.
Permanent Total Disability Award for auto mechanic
We obtained a Permanent Total Disability Award for an auto mechanic who injured his Lumbar Spine at two disc levels, Level L4-L5, L5-S1 which required a double fusion surgery. He injured his lower back when he was attempting to lift a tire rim off of a wheel balancer machine. Permanent Total Disability Award for NurseWe also obtained a Permanent Total Disability Award for a Nurse who was injured on the job while she was attempting to lift and turn a patient in a Nursing Home. She had sustained minor injuries to her back several times over her 10 plus years working for a Nursing Home however, none of them were serious enough to cause her to miss any substantial amount of time from work in the past. She continued to work after this injury and was released from care by the Employers medical doctors. She was not happy with her first attorney and she hired us to follow through on her claim. We sent her to one of our doctors who diagnosed her with a herniated disc at L4-L5 and stated he believed that she was unable to work and was in need of further medical treatment. By obtaining this doctors opinion, we forced the Employers Workers Compensation Insurance Carrier to send her back to another doctor for re-examination. The new Employer Orthopedic Surgeon determined that she was in need of further medical treatment and actually agreed with our doctor. Thereafter, she went through a two level lumbar disc fusion surgery then and went through a slow process of physical therapy, work hardening and recovery over the following year. The Employers doctor rated her at 20% Permanent Partial Disability. We sent her to another doctor of ours to obtain a rating who gave an opinion that she was Permanently and Totally Disabled due to her injuries, or in other words, was 100% disabled. After her trial in the matter, the Administrative Law Judge found in our favor and Awarded our client a Permanent Total Disability Award including the payment of a Permanent Partial Disability Lump Sum Payment, all past medical bills, payment for all future medical treatment as well as weekly payments for the rest of her life in the amount of $350.00.
